Welcome to Gate Main GmbH (“Gate Main”, “we”, “our”, or “us”).
These Terms and Conditions (“Terms”) and Privacy Policy (“Policy”) govern your access to and use of the Gate Main Technology Platform and the Gate Main Marketplace (collectively, the “Services”).

By accessing or using our systems, portals, or APIs, you (“Client”, “User”, or “Partner”) agree to these Terms and acknowledge that you have read and understood our Privacy Policy.


2. Definitions

  • Platform: All digital systems operated by Gate Main, including B2B/B2C portals, API/XML connections, and related software.
  • Marketplace: The Gate Main environment where travel businesses buy and sell travel-related products.
  • Client/User: Any individual or entity registered to use Gate Main’s services.
  • Wallet: Prepaid balance account used for transactions.
  • Products: Travel and hospitality services offered (e.g., hotels, transfers, activities, tours, flights).

3. Access and License

3.1 License Grant
Gate Main grants a non-exclusive, non-transferable license to access and use its platform for legitimate business operations.

3.2 Restrictions
The Client may not:

  • Reverse-engineer or copy system architecture;
  • Share login credentials;
  • Use the system for fraudulent or unauthorized purposes.

3.3 System Updates
Gate Main may modify, enhance, or upgrade its system features at any time without prior notice.


4. Marketplace Use

4.1 Transactions
Registered Clients may buy or sell travel services via the Gate Main Marketplace.

4.2 Accuracy of Information
Each Client is responsible for ensuring that product listings (prices, availability, policies, and descriptions) are accurate and updated.

4.3 Pricing and Taxes
All marketplace prices are in EUR (€) and are net prices, exclusive of local or resort taxes unless otherwise stated.

4.4 Payment Settlement
All marketplace transactions are executed through Gate Main’s wallet or secure payment gateway.

4.5 Verification
Gate Main reserves the right to verify company credentials before granting or maintaining marketplace access.


5. Payment and Wallet Policy

5.1 Prepaid Wallet
All purchases and bookings require a funded wallet. Bookings are confirmed only when sufficient funds are available.

5.2 Automatic Deductions
The system automatically deducts transaction amounts at the time of booking.

5.3 Refunds
Refunds for eligible cancellations are credited to the Client’s wallet or original payment method.
Chargebacks are not accepted for confirmed or used bookings.

5.4 Dispute Period
Clients must report payment discrepancies within 5 working days of receiving a statement.

5.5 Non-Payment
Failure to maintain sufficient wallet funds may lead to booking cancellations or account suspension.


6. Cancellations and Amendments

6.1 Provider Rules Apply
Cancellations and amendments follow the policies of the respective suppliers (hotels, airlines, DMCs, etc.).

6.2 Client Responsibility
The Client bears all financial consequences for late cancellations or no-shows.

6.3 Refund Processing
Refunds (if applicable) are processed within 14–30 business days, depending on supplier confirmation.


7. Data Protection and Privacy Policy

Gate Main GmbH respects your privacy and is committed to protecting personal data in compliance with the EU General Data Protection Regulation (GDPR) and Austrian data protection laws.

9. Service Availability and Maintenance

Gate Main aims to maintain 99% uptime and may perform scheduled maintenance when necessary.
Temporary downtime due to technical issues or force majeure does not constitute a breach of contract.


10. Liability and Indemnity

Gate Main acts solely as a technology and marketplace provider and is not responsible for the actual provision of travel services by suppliers.
Clients agree to indemnify Gate Main against any losses, claims, or damages arising from misuse or non-compliance with these Terms.


11. Force Majeure

Gate Main shall not be liable for delays or non-performance caused by events beyond its control, including natural disasters, wars, strikes, cyberattacks, or third-party supplier failures.


12. Termination

Gate Main reserves the right to suspend or terminate any account for:

  • Breach of contract;
  • Fraudulent activity;
  • Violation of data or payment policies;
  • Non-payment of dues.

Clients may request termination with 30 days’ written notice, provided all balances are settled.


13. Governing Law and Jurisdiction

These Terms and the Privacy Policy are governed by Austrian law.
Any disputes shall be settled through arbitration at the Vienna International Arbitral Centre (VIAC), Vienna, Austria.


14. Updates to These Terms

Gate Main reserves the right to modify or update these Terms and the Privacy Policy at any time.
Changes will take effect immediately upon publication on www.gatemain.com.
